Ilene S. Schnall, Member

Gina Cadogan
focuses her practice on commercial and civil litigation, labor and employment litigation and training and insurance bad faith litigation. She gained her extensive Federal and State Court experience while working at large national and international law firms, as well as trial counsel to the World’s largest insurance company. Gina has litigated complex multi-million dollar cases on behalf of individuals, municipalities and Fortune 500 companies, including a national airline, national auto dealerships, construction companies, hotel chains and trucking companies both in Federal and State Court. Gina is also active in several local, State and Federal bar associations, as well as a number of charitable organizations.

OPINIONS
  • Whitaker and Allied Pilots Association v. American Airlines, Inc. , 285 F.3d 940 (11th Cir. 2002) (Ms. Cadogan represented American Airlines, Inc. in successfully dismissing a probationary pilot’s and his certified bargaining representative’s complaint alleging that American Airlines was obligated to arbitrate a probationary employee’s termination grievance pursuant to the Railway Labor Act. The Eleventh Circuit affirmed the dismissal based upon the board of adjustment having no jurisdiction to hear the termination grievance of a probationary employee who asserts no substantive rights under the collective bargaining agreement.)
  • Garner v. Garner , 2006 Fla. App. LEXIS 15113 (3d DCA August 17, 2006)(Ms. Cadogan successfully obtained a denial of certiorari review of the trial court’s discovery order denying the disclosure of a law firm’s litigation files.)
  • Gonzalez v. Carpenters Contractors of America , Broward County Circuit Court (Case No. CACE 02012988) (decided July 2, 2002) (Ms. Cadogan successfully obtained a summary judgment based upon workers’ compensation immunity.)
  • Patterson Dental Company v. Henry Schein, Inc. and Harry Christman, III , Hillsborough County Circuit Court (Case No. CACE95-6414) (appeal voluntarily dismissed at 771 So. 2d 534 (Fla. 2d DCA 2000)) (Ms. Cadogan successfully second chaired trial wherein the court found that the Defendants did not misappropriate the Plaintiff’s trade secrets or confidential information.)
